자본시장과 금융투자업에 관한 법률 제434조의2(과오납금의 환급)

① 금융위원회는 과징금 납부의무자가 이의신청의 재결 또는 법원의 판결 등의 사유로 과징금 과오납금의 환급을 청구하는 경우에는 지체 없이 환급하여야 하며, 과징금 납부의무자의 청구가 없어도 금융위원회가 확인한 과오납금은 환급하여야 한다.

② 금융위원회는 제1항에 따라 과오납금을 환급하는 경우 환급받을 자가 금융위원회에 납부하여야 하는 과징금이 있으면 환급하는 금액을 과징금에 충당할 수 있다.
