장애인차별금지 및 권리구제 등에 관한 법률 제28조(모ㆍ부성권의 차별금지)

①누구든지 장애인의 임신, 출산, 양육 등 모ㆍ부성권에 있어 장애를 이유로 제한ㆍ배제ㆍ분리ㆍ거부하여서는 아니 된다.

②입양기관은 장애인이 입양하고자 할 때 장애를 이유로 입양할 수 있는 자격을 제한하여서는 아니 된다.

③교육책임자 및 「영유아보육법」에 따른 어린이집 및 그 보육교직원와 「아동복지법」에 따른 아동복지시설 및 그 종사자 등은 부모가 장애인이라는 이유로 그 자녀를 구분하거나 불이익을 주어서는 아니 된다. <개정 2011.6.7>

④국가 및 지방자치단체에서 직접 운영하거나 그로부터 위탁 혹은 지원을 받아 운영하는 기관은 장애인의 피임 및 임신ㆍ출산ㆍ양육 등에 있어서의 실질적인 평등을 보장하기 위하여 관계 법령으로 정하는 바에 따라 장애유형 및 정도에 적합한 정보ㆍ활동보조 서비스 등의 제공 및 보조기기ㆍ도구 등의 개발 등 필요한 지원책을 마련하여야 한다.

⑤국가 및 지방자치단체는 임신ㆍ출산ㆍ양육 등의 서비스 제공과 관련하여 이 법에서 정한 차별행위를 하지 아니하도록 홍보ㆍ교육ㆍ지원ㆍ감독하여야 한다.
