장애인차별금지 및 권리구제 등에 관한 법률 제30조(가족ㆍ가정ㆍ복지시설 등에서의 차별금지)

①가족ㆍ가정 및 복지시설 등의 구성원은 장애인의 의사에 반하여 과중한 역할을 강요하거나 장애를 이유로 정당한 사유 없이 의사결정과정에서 장애인을 배제하여서는 아니 된다.

②가족ㆍ가정 및 복지시설 등의 구성원은 정당한 사유 없이 장애인의 의사에 반하여 장애인의 외모 또는 신체를 공개하여서는 아니 된다.

③가족ㆍ가정 및 복지시설 등의 구성원은 장애를 이유로 장애인의 취학 또는 진학 등 교육을 받을 권리와 재산권 행사, 사회활동 참여, 이동 및 거주의 자유(이하 이 항에서 "권리 등"이라 한다)를 제한ㆍ박탈ㆍ구속하거나 권리 등의 행사로부터 배제하여서는 아니 된다.

④가족ㆍ가정의 구성원인 자 또는 구성원이었던 자는 자녀 양육권과 친권의 지정 및 면접교섭권에 있어 장애인에게 장애를 이유로 불리한 합의를 강요하거나 그 권리를 제한ㆍ박탈하여서는 아니 된다.

⑤복지시설 등의 장은 장애인의 시설 입소를 조건으로 친권포기각서를 요구하거나 시설에서의 생활 중 가족 등의 면접권 및 외부와의 소통권을 제한하여서는 아니 된다.
