장애인차별금지 및 권리구제 등에 관한 법률 제32조(괴롭힘 등의 금지)

①장애인은 성별, 연령, 장애의 유형 및 정도, 특성 등에 상관없이 모든 폭력으로부터 자유로울 권리를 가진다.

②괴롭힘 등의 피해를 당한 장애인은 상담 및 치료, 법률구조, 그 밖에 적절한 조치를 받을 권리를 가지며, 괴롭힘 등의 피해를 신고하였다는 이유로 불이익한 처우를 받아서는 아니 된다.

③누구든지 장애를 이유로 학교, 시설, 직장, 지역사회 등에서 장애인 또는 장애인 관련자에게 집단따돌림을 가하거나 모욕감을 주거나 비하를 유발하는 언어적 표현이나 행동을 하여서는 아니 된다.

④누구든지 장애를 이유로 사적인 공간, 가정, 시설, 직장, 지역사회 등에서 장애인 또는 장애인 관련자에게 유기, 학대, 금전적 착취를 하여서는 아니 된다.

⑤누구든지 장애인의 성적 자기결정권을 침해하거나 수치심을 자극하는 언어표현, 희롱, 장애 상태를 이용한 추행 및 강간 등을 행하여서는 아니 된다.

⑥국가 및 지방자치단체는 장애인에 대한 괴롭힘 등을 근절하기 위한 인식개선 및 괴롭힘 등 방지 교육을 실시하고 적절한 시책을 강구하여야 한다.
