장애인차별금지 및 권리구제 등에 관한 법률 제47조(입증책임의 배분)

①이 법률과 관련한 분쟁해결에 있어서 차별행위가 있었다는 사실은 차별행위를 당하였다고 주장하는 자가 입증하여야 한다.

②제1항에 따른 차별행위가 장애를 이유로 한 차별이 아니라거나 정당한 사유가 있었다는 점은 차별행위를 당하였다고 주장하는 자의 상대방이 입증하여야 한다.
