장애인차별금지 및 권리구제 등에 관한 법률 제5조(차별판단)

①차별의 원인이 2가지 이상이고, 그 주된 원인이 장애라고 인정되는 경우 그 행위는 이 법에 따른 차별로 본다.

②이 법을 적용함에 있어서 차별 여부를 판단할 때에는 장애인 당사자의 성별, 장애의 유형 및 정도, 특성 등을 충분히 고려하여야 한다.
