재난 및 안전관리 기본법 시행령 제52조(응급부담의 절차)

① 시장ㆍ군수ㆍ구청장 및 지역통제단장은 법 제45조에 따라 응급조치 종사명령을 할 때에는 그 대상자에게 행정안전부령으로 정하는 바에 따라 응급조치종사명령서를 발급하여야 한다. 다만, 긴급한 경우에는 구두로 응급조치 종사를 명한 후 행정안전부령으로 정하는 바에 따라 응급조치종사명령에 따른 사람에게 응급조치종사확인서를 발급하여야 한다. <개정 2013.3.23, 2014.11.19, 2017.7.26>

② 시장ㆍ군수ㆍ구청장 및 지역통제단장은 법 제45조에 따라 다른 사람의 토지ㆍ건축물ㆍ공작물, 그 밖의 소유물을 일시 사용하거나 장애물을 변경 또는 제거할 때에는 행정안전부령으로 정하는 바에 따라 그 관계인에게 응급부담의 목적ㆍ기간ㆍ대상 및 내용 등을 분명하게 적은 응급부담명령서를 발급하여야 한다. 다만, 긴급한 경우에는 구두로 응급부담을 명한 후 행정안전부령으로 정하는 바에 따라 관계인에게 응급부담확인서를 발급하여야 한다. <개정 2013.3.23, 2014.11.19, 2017.7.26>

③ 제2항 본문에 따른 응급부담명령서를 발급할 대상자를 알 수 없거나 그 소재지를 알 수 없을 때에는 이를 해당 시ㆍ군ㆍ구의 게시판에 15일 이상 게시하여야 한다.

④ 제2항 단서에 따라 구두로 응급부담을 명할 대상자가 없거나 그 소재지를 알 수 없을 때에는 응급부담조치를 한 후 그 사실을 해당 시ㆍ군ㆍ구의 게시판에 15일 이상 게시하여야 한다.
