재난 및 안전관리 기본법 제65조(치료 및 보상)

① 재난 발생 시 긴급구조활동과 응급대책ㆍ복구 등에 참여한 자원봉사자, 제45조에 따른 응급조치 종사명령을 받은 사람 및 제51조제2항에 따라 긴급구조활동에 참여한 민간 긴급구조지원기관의 긴급구조지원요원이 응급조치나 긴급구조활동을 하다가 부상(신체적ㆍ정신적 손상을 말한다. 이하 이 조에서 같다)을 입은 경우 및 부상으로 인하여 장애를 입은 경우에는 치료(심리적 안정과 사회적응을 위한 상담지원을 포함한다)를 실시하고 보상금을 지급하며, 사망(부상으로 인하여 사망한 경우를 포함한다)한 경우에는 그 유족에게 보상금을 지급한다. 다만, 다른 법령에 따라 국가나 지방자치단체의 부담으로 같은 종류의 보상금을 받은 사람에게는 그 보상금에 상당하는 금액을 지급하지 아니한다. <개정 2020.10.20, 2023.12.26>

② 재난의 응급대책ㆍ복구 및 긴급구조 등에 참여한 자원봉사자의 장비 등이 응급대책ㆍ복구 또는 긴급구조와 관련하여 고장나거나 파손된 경우에는 그 자원봉사자에게 수리비용을 보상할 수 있다.

③ 제1항에 따른 치료 및 보상금은 국가나 지방자치단체가 부담하며, 그 기준과 절차 등에 관한 사항은 대통령령으로 정한다.
