저작권법 시행령 제61조(조정의 절차 등)

① 법 제114조의2에 따른 분쟁의 조정을 신청하려는 자는 위원회가 정하는 바에 따라 조정신청서를 위원회에 제출하여야 한다. <개정 2009.7.22>

② 제1항에 따라 조정을 신청하는 자는 조정비용의 일부를 미리 납부하고, 조정이 성립된 경우에는 각 당사자가 나머지 조정비용을 납부하여야 한다. 이 경우 조정비용의 납부절차는 위원회의 의결을 거쳐 위원회의 위원장이 정한다. <신설 2009.7.22>

③위원장은 제1항에 따른 조정신청을 받으면 조정부를 지정하고, 조정신청서를 조정부에 회부하여야 한다. <개정 2009.7.22>

④조정부는 조정안을 작성하여 당사자에게 제시하여야 한다. 다만, 조정이 성립되지 아니할 것이 명백한 경우에는 그러하지 아니하다. <개정 2009.7.22>

⑤조정부는 조정신청이 있는 날부터 3개월 이내에 조정하여야 한다. 다만, 특별한 사유가 있는 경우에는 양 당사자의 동의를 얻어 1개월의 범위에서 1회에 한하여 그 기간을 연장할 수 있다. <개정 2009.7.22>

⑥ 법 제119조제1항제2호에 따른 감정이 실시되는 경우 감정기간은 제5항의 조정기간에 산입하지 아니한다. <신설 2009.7.22>
