저작권법 제50조(저작재산권자 불명인 저작물의 이용)

①누구든지 대통령령으로 정하는 기준에 해당하는 상당한 노력을 기울였어도 공표된 저작물의 저작재산권자나 그의 거소를 알 수 없어 그 저작물의 이용허락을 받을 수 없는 경우에는 대통령령으로 정하는 바에 따라 문화체육관광부장관의 승인을 얻은 후 문화체육관광부장관이 정하는 기준에 의한 보상금을 위원회에 지급하고 이를 이용할 수 있다. <개정 2008.2.29, 2019.11.26, 2020.2.4>

②제1항의 규정에 따라 저작물을 이용하는 자는 그 뜻과 승인연월일을 표시하여야 한다.

③제1항의 규정에 따라 법정허락된 저작물이 다시 법정허락의 대상이 되는 때에는 제1항의 규정에 따른 대통령령으로 정하는 기준에 해당하는 상당한 노력의 절차를 생략할 수 있다. 다만, 그 저작물에 대한 법정허락의 승인 이전에 저작재산권자가 대통령령으로 정하는 절차에 따라 이의를 제기하는 때에는 그러하지 아니하다. <개정 2021.5.18>

④문화체육관광부장관은 대통령령으로 정하는 바에 따라 법정허락 내용을 정보통신망에 게시하여야 한다. <개정 2008.2.29, 2021.5.18>

⑥ 위원회는 제1항에 따라 보상금을 지급받은 날부터 10년이 지난 미분배 보상금에 대하여 문화체육관광부장관의 승인을 얻어 제25조제10항 각 호의 어느 하나에 해당하는 목적을 위하여 사용할 수 있다. <신설 2019.11.26, 2020.2.4, 2023.8.8>
