전기통신사업법 제40조(상호접속의 대가)

① 상호접속의 이용대가는 공정하고 타당한 방법으로 산정하여 상호정산하여야 하며 구체적인 산정기준 및 절차와 지급방법은 제39조제2항의 기준에 따른다.

② 전기통신사업자는 상호접속의 방법, 접속통화의 품질 또는 상호접속에 필요한 정보의 제공 등에서 자신의 책임이 아닌 사유로 불이익을 받은 경우에는 제39조제2항의 기준에 따라 상호접속의 이용 대가를 줄여 상호정산할 수 있다.
