Enforcement Decree of the Act on Consumer Protection in Electronic Commerce, Article 34-3 (Methods, etc. of Temporary Suspension Orders)
① 공정거래위원회는 법 제32조의4제1항에 따라 법 제32조제2항에 따른 시정조치 또는 같은 조 제4항 각 호 외의 부분에 따른 영업의 전부 또는 일부의 정지를 명하기 전까지 법 제32조의4제1항 각 호 외의 부분에 따른 임시중지(이하 "임시중지"라 한다)를 명할 수 있다. <개정 2026.7.20>
(1) Pursuant to Article 32-4 (1) of the Act, the Fair Trade Commission may order a temporary suspension under the part of Article 32-4 (1) of the Act other than its subparagraphs (hereinafter referred to as a "temporary suspension") until it orders corrective measures under Article 32 (2) of the Act or the suspension of all or part of the business under the part of paragraph (4) of the same Article other than its subparagraphs.
② 법 제32조의4제2항에서 "해당 역무제공의 중단 등 대통령령으로 정하는 조치"란 해당 전자상거래를 하는 사업자 또는 통신판매업자에게 취하는 조치로서 다음 각 호의 구분에 따른 조치를 말한다. <개정 2026.7.20>
(2) "Measures prescribed by Presidential Decree, such as stopping the provision of the relevant services" in Article 32-4 (2) of the Act means the following measures, according to the following categories, taken against the business operator engaged in electronic commerce or mail order seller concerned:
1. 호스팅서비스를 제공하는 자: 호스팅서비스 제공 중단
1. A person providing a hosting service: stopping the provision of the hosting service;
2. 통신판매중개자: 사이버몰의 이용을 허락하는 행위 또는 거래 당사자 간의 통신판매를 알선하는 행위 중단
2. A mail order broker: stopping the act of permitting the use of the cybermall or the act of arranging mail order sales between the parties to a transaction;
3. 전자게시판서비스 제공자: 전자게시판서비스 제공 중단 또는 전자게시판 게시물의 차단
3. An electronic bulletin board service provider: stopping the provision of the electronic bulletin board service or blocking posts on the electronic bulletin board.
