전자상거래 등에서의 소비자보호에 관한 법률 제20조의5(국내대리인의 지정)

① 국내에 주소 또는 영업소가 없는 통신판매업자 또는 통신판매중개자(이하 "통신판매업자등"이라 한다)로서 매출액, 소비자 규모 등을 고려하여 대통령령으로 정하는 기준에 해당하는 자는 다음 각 호의 구분에 따른 사항을 대리하는 자(이하 "국내대리인"이라 한다)를 서면으로 지정하여야 한다.

② 국내대리인은 국내에 주소 또는 영업소가 있는 자로 한다. 이 경우 다음 각 호의 어느 하나에 해당하는 법인이 있는 통신판매업자등은 그 법인 중에서 국내대리인을 지정하여야 한다.

③ 제1항에 따라 국내대리인을 지정한 통신판매업자등은 다음 각 호의 사항을 모두 공정거래위원회에 제출한 후 통신판매업자등의 인터넷 홈페이지 등에 공개하여야 한다. 국내대리인을 변경한 경우에도 또한 같다.

④ 국내대리인이 제1항 각 호와 관련하여 이 법을 위반한 경우에는 해당 국내대리인을 지정한 통신판매업자등이 그 행위를 한 것으로 본다.

⑤ 국내대리인은 해당 국내대리인을 지정한 통신판매업자등과 유효한 연락수단을 확보하여야 한다.

⑥ 공정거래위원회는 통신판매업자등이 제1항에 따라 국내대리인을 지정하여야 하는 기준에 해당하는지 확인하기 위하여 해당 사업자에게 매출액, 소비자 규모 등 대통령령으로 정하는 사항에 관한 자료의 제출을 요구할 수 있다. 이 경우 자료의 제출을 요구받은 사업자는 정당한 사유가 없으면 이에 따라야 한다.

⑦ 제3항에 따른 제출 및 공개에 필요한 사항은 대통령령으로 정한다.
