정보통신망 이용촉진 및 정보보호 등에 관한 법률 시행령 제34조(불법정보의 처리제한명령 등의 요청)

① 관계 중앙행정기관의 장[법 제44조의7제1항제9호의 정보 중 「성폭력범죄의 처벌 등에 관한 특례법」 제14조에 따른 촬영물 또는 복제물(복제물의 복제물을 포함한다)에 대해서는 공소청(광역공소청, 지방공소청 및 지방공소청 지청을 포함한다) 또는 수사기관의 장을 포함한다. 이하 이 조에서 같다]이 법 제44조의7제4항에 따라 방송미디어통신위원회에 정보통신서비스 제공자 또는 게시판 관리ㆍ운영자에게 같은 조 제1항제7호부터 제9호까지의 정보의 처리를 거부ㆍ정지 또는 제한하도록 하는 명령을 하여 줄 것을 요청하려는 때에는 다음 각 호의 사항을 적은 요청서를 증빙자료와 함께 방송미디어통신위원회에 제출해야 한다. <개정 2009.1.28, 2016.9.22, 2019.6.11, 2025.10.1, 2026.7.7, 2026.9.29>

② 방송미디어통신위원회는 제1항에 따라 제출된 서류 등에 흠이 있음을 발견한 때에는 즉시 관계 중앙행정기관의 장에게 보완을 요구할 수 있다. 이 경우 5일 이상의 보완기간을 부여하여야 한다. <개정 2025.10.1>
