정보통신망 이용촉진 및 정보보호 등에 관한 법률 시행령 제35조의11(과징금의 부과 대상 및 기준 등)

Enforcement Decree of the Act on Promotion of Information and Communications Network Utilization and Information Protection, Article 35-11 (Persons Subject to Penalty Surcharges and Criteria for Imposition, etc.)

① 방송미디어통신위원회는 법 제44조의24제1항에 따라 정보통신망을 통하여 사실이나 의견을 불특정 다수에게 전달하는 것을 업으로 하는 자로서 다음 각 호의 요건에 모두 해당하는 자에게 과징금을 부과한다.

(1) Under언더 Article아터클 44-24 (1) of어^v브 the^ð디 Act,액트 the^ð더 Broadcasting,브^r로드캐스팅 Media미디아 and앤드 Communications커뮤너케이션즈 Commission커미션 shall섈 impose임포우즈 a어 penalty페널티 surcharge서차지 on안 a어 person퍼슨 whose후즈 business비즈니스 is이즈 conveying컨^v베이잉 facts^f팩츠 or오 opinions어피니언즈 to투 many메니 unspecified언스페서^f파이드 persons퍼슨즈 through^θ쓰^r루 an앤 information인^f퍼메이션 and앤드 communications커뮤너케이션즈 network네트워크 and앤드 who후 meets밋츠 all올 of어^v브 the^ð더 following^f팔로잉 requirements:^r리콰이어먼츠

1. 불법정보 또는 허위조작정보로 인정되어 법 제44조의24제1항에 따른 판결이 확정된 이후 해당 정보를 정보통신망에 2회 이상 유통한 자

2. 제1호에 따른 정보를 정보통신망에 2회 이상 유통할 당시(해당 정보를 정보통신망에 게재한 날을 말한다) 직전 3개월 동안 총 3개 이상의 정보를 게재하여 광고, 후원 또는 그 밖의 방법을 통해 수익을 얻은 자

② 법 제44조의24제1항에 따른 과징금의 부과기준은 별표 1의4와 같다.

③ 방송미디어통신위원회는 법 제44조의24제1항에 따른 과징금의 산정을 위하여 재무제표 등 자료가 필요한 경우에는 30일 이내의 기간을 정하여 해당 게재자에게 관련 자료의 제출을 요청할 수 있다.
