정신건강증진 및 정신질환자 복지서비스 지원에 관한 법률 제58조(정신건강심사위원회 위원의 제척ㆍ기피ㆍ회피)

① 제57조에 따른 정신건강심사위원회의 입원등 기간의 연장과 퇴원등 또는 처우개선의 심사에서 그 사람의 입원등을 결정하였던 위원과 그 사람이 입원등을 하고 있는 정신의료기관등에 소속된 위원은 제척된다.

② 입원등 기간의 연장, 퇴원등 또는 처우개선의 심사를 청구한 자는 정신건강심사위원회의 위원에게 공정한 심사를 기대하기 어려운 사정이 있는 경우에는 위원회에 기피 신청을 할 수 있고, 위원회는 이를 결정한다. 이 경우 기피 신청의 대상인 위원은 그 심사에 참여하지 못한다.
