주민등록법 시행령 제23조(전입신고)

① 법 제16조제1항에 따른 전입신고는 거주자의 경우에는 세대 모두 이동 여부를 기준으로 별지 제15호서식 또는 별지 제15호의2서식에, 재외국민의 경우에는 별지 제15호의3서식에 따른다. <개정 2014.12.31, 2016.12.30>

② 법 제16조제1항에 따른 전입신고를 하는 경우 전입지의 세대주 또는 세대를 관리하는 사람과 전(前) 거주지의 세대주 또는 세대를 관리하는 사람이 다른 경우에는 다음 각 호의 방법에 따라 신고해야 한다. <개정 2023.11.21, 2026.4.28>

③ 시장ㆍ군수 또는 구청장은 제2항제2호 단서에 따라 신고인 본인의 배우자 또는 직계혈족 여부의 확인을 위해 「민원 처리에 관한 법률」 제10조의2에 따른 본인정보 공동이용 또는 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통해 신고인의 가족관계증명서를 확인해야 한다. 다만, 신고인이 그 확인에 동의하지 않는 경우에는 해당 서류를 제출하도록 해야 한다. <신설 2023.11.21, 2026.4.28>

④ 시장ㆍ군수 또는 구청장은 제1항에 따라 재외국민의 전입신고를 받으면 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통해 다음 각 호의 서류를 확인해야 하며, 재외국민 본인이 확인에 동의하지 않는 경우에는 해당 서류를 첨부하도록 해야 한다. <신설 2026.4.28>

⑤ 시장ㆍ군수 또는 구청장은 법 제16조제1항에 따른 전입신고를 받은 경우 신고자에 대한 본인확인을 하고 신거주지에 주민등록되어 있는 전입세대의 수를 확인한 후 전입자의 주민등록표와 세대별 주민등록표 색인부에 전입신고일자, 전입사유와 관계 공무원의 성명을 기록하여야 한다. <개정 2013.12.17, 2023.11.21, 2026.4.28>
