Enforcement Decree of the Resident Registration Act, Article 44 (Retrieval and Destruction, etc. of Resident Registration Cards)

① 시장ㆍ군수 또는 구청장은 다음 각 호의 어느 하나에 해당하는 사유가 발생하면 종전의 주민등록증을 회수하여야 한다. <개정 2009.8.13, 2013.12.17, 2014.12.31>

1. 주민등록증을 발급받은 사람이 사망한 경우

2. 법 제27조제1항 각 호의 사유로 주민등록증을 재발급한 경우. 다만, 법 제27조제1항제1호 또는 이 영 제40조제3항제7호의 사유로 재발급한 경우는 제외한다.

③ 시장ㆍ군수 또는 구청장은 제26조제5항에 따라 국외이주신고자의 출국을 통보받은 경우 또는 제26조의3제1항에 따라 현지이주자의 명단을 통보받은 경우에는 국외이주자 또는 현지이주자에게 발급된 거주자용 주민등록증을 주민등록정보시스템을 통해 사용불능 처리해야 한다. <신설 2014.12.31, 2023.1.10>
