주택법 시행령 제10조(도시형 생활주택)
Enforcement Decree of the Housing Act, Article 10 (Urban-Type Residential Housing)
① 법 제2조제20호에서 "대통령령으로 정하는 주택"이란 「국토의 계획 및 이용에 관한 법률」 제36조제1항제1호에 따른 도시지역에 건설하는 다음 각 호의 주택을 말한다. <개정 2022.2.11, 2023.4.7, 2024.3.19, 2025.1.21, 2026.9.8>
(1) The term "housing prescribed by Presidential Decree" in Article 2, subparagraph 20 of the Act means the following housing built in an urban area under Article 36 (1) 1 of the National Land Planning and Utilization Act:
1. 아파트형 주택: 다음 각 목의 요건을 모두 갖춘 아파트
1. Apartment-type housing: apartments that meet all of the following requirements:
가. 세대별로 독립된 주거가 가능하도록 욕실 및 부엌을 설치할 것
(a) A bathroom and kitchen shall be installed so that each household can live independently;
나. 지하층에는 세대를 설치하지 않을 것
(b) No household unit shall be placed on a basement floor;
2. 단지형 연립주택: 연립주택. 다만, 「건축법」 제5조제2항에 따라 같은 법 제4조에 따른 건축위원회의 심의를 받은 경우에는 주택으로 쓰는 층수를 다음 각 목의 구분에 따라 건축할 수 있다.
2. Complex-type row houses: row houses. However, where deliberation by a building committee under Article 4 of the Building Act has been obtained under Article 5 (2) of the same Act, the number of stories used as housing may be built as follows:
가. 「국토의 계획 및 이용에 관한 법률 시행령」 제30조제1항제1호가목(1)의 제1종전용주거지역 또는 같은 호 나목(1)의 제1종일반주거지역에 건설하는 경우: 5개층까지
(a) Where built in a Class I exclusive residential area under Article 30 (1) 1 (a) (1) of the Enforcement Decree of the National Land Planning and Utilization Act, or in a Class I general residential area under item (b) (1) of the same subparagraph: up to five stories;
나. 그 밖의 지역에 건설하는 경우: 6개층까지
(b) Where built in any other area: up to six stories;
3. 단지형 다세대주택: 다세대주택. 다만, 「건축법」 제5조제2항에 따라 같은 법 제4조에 따른 건축위원회의 심의를 받은 경우에는 주택으로 쓰는 층수를 다음 각 목의 구분에 따라 건축할 수 있다.
3. Complex-type multiplex housing: multiplex housing. However, where deliberation by a building committee under Article 4 of the Building Act has been obtained under Article 5 (2) of the same Act, the number of stories used as housing may be built as follows:
가. 「국토의 계획 및 이용에 관한 법률 시행령」 제30조제1항제1호가목(1)의 제1종전용주거지역 또는 같은 호 나목(1)의 제1종일반주거지역에 건설하는 경우: 5개층까지
(a) Where built in a Class I exclusive residential area under Article 30 (1) 1 (a) (1) of the Enforcement Decree of the National Land Planning and Utilization Act, or in a Class I general residential area under item (b) (1) of the same subparagraph: up to five stories;
나. 그 밖의 지역에 건설하는 경우: 6개층까지
(b) Where built in any other area: up to six stories.
② 하나의 건축물에는 도시형 생활주택과 그 밖의 주택을 함께 건축할 수 없다. 다만, 다음 각 호의 어느 하나에 해당하는 경우는 예외로 한다. <개정 2021.10.14, 2022.2.11, 2025.1.21>
(2) Urban-type residential housing and other housing may not be built together in one building. However, this shall not apply in any of the following cases:
1. 도시형 생활주택과 주거전용면적이 85제곱미터를 초과하는 주택 1세대를 함께 건축하는 경우
1. Where urban-type residential housing is built together with one household of housing whose exclusive residential area exceeds 85 square meters;
2. 「국토의 계획 및 이용에 관한 법률 시행령」 제30조제1항제1호다목에 따른 준주거지역 또는 같은 항 제2호에 따른 상업지역에서 아파트형 주택과 도시형 생활주택 외의 주택을 함께 건축하는 경우
2. Where apartment-type housing and housing other than urban-type residential housing are built together in a semi-residential area under Article 30 (1) 1 (c) of the Enforcement Decree of the National Land Planning and Utilization Act or in a commercial area under subparagraph 2 of the same paragraph.
③ 하나의 건축물에는 단지형 연립주택 또는 단지형 다세대주택과 아파트형 주택을 함께 건축할 수 없다. <개정 2022.2.11, 2025.1.21>
(3) Complex-type row houses or complex-type multiplex housing may not be built together with apartment-type housing in one building.
