중대재해 처벌 등에 관한 법률 시행령 제6조(안전보건교육의 실시 등)

① 법 제8조제1항에 따른 안전보건교육(이하 "안전보건교육"이라 한다)은 총 20시간의 범위에서 고용노동부장관이 정하는 바에 따라 이수해야 한다.

② 안전보건교육에는 다음 각 호의 사항이 포함되어야 한다.

(2) Safety세이^f프티 and앤드 health헬^θ스 education에저케이션 shall섈 include인클루드 the^ð더 following:^f팔로잉

③ 고용노동부장관은 「한국산업안전보건공단법」에 따른 한국산업안전보건공단이나 「산업안전보건법」 제33조에 따라 등록된 안전보건교육기관(이하 "안전보건교육기관등"이라 한다)에 안전보건교육을 의뢰하여 실시할 수 있다.

(3) The^ð더 Minister미너스터 of어^v브 Employment엠플로이먼트 and앤드 Labor레이버 may메이 commission커미션 the^ð더 Korea코^r리아 Occupational아큐페이셔늘 Safety세이^f프티 and앤드 Health헬^θ스 Agency에이전시 under언더 the^ð더 Korea코^r리아 Occupational아큐페이셔늘 Safety세이^f프티 and앤드 Health헬^θ스 Agency에이전시 Act액트 or오 a어 safety세이^f프티 and앤드 health헬^θ스 education에저케이션 institution인스티투션 registered^r레지스터드 under언더 Article아터클 33 of어^v브 the^ð디 Occupational아큐페이셔늘 Safety세이^f프티 and앤드 Health헬^θ스 Act액트 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 a어 "safety세이^f프티 and앤드 health헬^θ스 education에저케이션 institution,인스티투션 etc.")엣세터^r러 to투 provide프^r러^v바이드 safety세이^f프티 and앤드 health헬^θ스 education.에저케이션

④ 고용노동부장관은 분기별로 중대산업재해가 발생한 법인 또는 기관을 대상으로 안전보건교육을 이수해야 할 교육대상자를 확정하고 안전보건교육 실시일 30일 전까지 다음 각 호의 사항을 해당 교육대상자에게 통보해야 한다.

⑤ 제4항에 따른 통보를 받은 교육대상자는 해당 교육일정에 참여할 수 없는 정당한 사유가 있는 경우에는 안전보건교육 실시일 7일 전까지 고용노동부장관에게 안전보건교육의 연기를 한 번만 요청할 수 있다.

⑥ 고용노동부장관은 제5항에 따른 연기 요청을 받은 날부터 3일 이내에 연기 가능 여부를 교육대상자에게 통보해야 한다.

(6) The^ð더 Minister미너스터 of어^v브 Employment엠플로이먼트 and앤드 Labor레이버 shall섈 notify노우터^f파이 the^ð더 person퍼슨 within위^ð딘 three^θ쓰^r리 days데이즈 from^f프^r럼 the^ð더 date데잇 of어^v브 receiving^r러시^v빙 a어 request^r리퀘스트 for^f포 postponement포스트폰먼트 under언더 paragraph패^r러그^r래^f프 (5) whether웨^ð더 the^ð더 postponement포스트폰먼트 is이즈 possible.파서블

⑦ 안전보건교육을 연기하는 경우 교육일정 등의 통보에 관하여는 제4항을 준용한다.

(7) Where웨어 safety세이^f프티 and앤드 health헬^θ스 education에저케이션 is이즈 postponed,포스트폰드 paragraph패^r러그^r래^f프 (4) shall섈 apply어플라이 mutatis뮤타티즈 mutandis뮤탠디즈 to투 the^ð더 notice노우티스 of어^v브 the^ð디 education에저케이션 schedule,스케줄 etc.엣세터^r러

⑧ 안전보건교육에 드는 비용은 안전보건교육기관등에서 수강하는 교육대상자가 부담한다.

(8) The^ð더 costs카스츠 of어^v브 safety세이^f프티 and앤드 health헬^θ스 education에저케이션 shall섈 be비 borne본 by바이 the^ð더 persons퍼슨즈 who후 take테이크 the^ð디 education에저케이션 at앳 the^ð더 safety세이^f프티 and앤드 health헬^θ스 education에저케이션 institution,인스티투션 etc.엣세터^r러

⑨ 안전보건교육기관등은 안전보건교육을 실시한 경우에는 지체 없이 안전보건교육 이수자 명단을 고용노동부장관에게 통보해야 한다.

(9) When웬 a어 safety세이^f프티 and앤드 health헬^θ스 education에저케이션 institution,인스티투션 etc.엣세터^r러 has해즈 provided프^r러^v바이디드 safety세이^f프티 and앤드 health헬^θ스 education,에저케이션 it잇 shall섈 notify노우터^f파이 the^ð더 Minister미너스터 of어^v브 Employment엠플로이먼트 and앤드 Labor레이버 of어^v브 the^ð더 list리스트 of어^v브 persons퍼슨즈 who후 completed컴플리티드 it잇 without위^ð다웃 delay.딜레이

⑩ 안전보건교육을 이수한 교육대상자는 필요한 경우 안전보건교육이수확인서를 발급해 줄 것을 고용노동부장관에게 요청할 수 있다.

⑪ 제10항에 따른 요청을 받은 고용노동부장관은 고용노동부장관이 정하는 바에 따라 안전보건교육이수확인서를 지체 없이 내주어야 한다.

(11) The^ð더 Minister미너스터 of어^v브 Employment엠플로이먼트 and앤드 Labor레이버 who후 receives^r러시^v브즈 a어 request^r리퀘스트 under언더 paragraph패^r러그^r래^f프 (10) shall섈 issue이슈 a어 certificate서티^f피컷 of어^v브 completion컴플리션 of어^v브 safety세이^f프티 and앤드 health헬^θ스 education에저케이션 without위^ð다웃 delay,딜레이 as애즈 determined디터먼드 by바이 the^ð더 Minister미너스터 of어^v브 Employment엠플로이먼트 and앤드 Labor.레이버
