중소기업기본법 제23조(의견 제출 등)

① 중소기업자ㆍ이해관계자와 관련 단체의 장은 제22조제2항에 따른 업무와 관련하여 중소기업 옴부즈만에게 의견을 제출할 수 있다. 이 경우 의견을 제출하는 방법 및 처리절차에 관하여는 「행정규제기본법」 제17조 및 「행정절차법」 제44조를 준용한다. <개정 2011.7.25, 2013.8.6>

In인 such서치 cases,케이시즈 Article아터클 17 of어^v브 the^ð더 Framework^f프^r레임워크 Act액트 on안 Administrative어드미너스트^r레이티^v브 Regulations^r레귤레이션즈 and앤드 Article아터클 44 of어^v브 the^ð디 Administrative어드미너스트^r레이티^v브 Procedures프^r러시저즈 Act액트 shall섈 apply어플라이 mutatis뮤타티즈 mutandis뮤탠디즈 to투 the^ð더 method메^θ써드 of어^v브 submitting서브미팅 opinions어피니언즈 and앤드 the^ð더 handling핸들링 procedures.프^r러시저즈

② 제1항의 의견 제출과 관계된 행정기관은 규제 개선 등에 관한 의견을 제출하였다는 이유로 그 의견을 제출한 자에게 불이익을 주거나 차별을 하여서는 아니 된다. <개정 2011.7.25>

③ 중소기업 옴부즈만은 제1항에 따라 의견을 제출한 자가 그 의견을 제출하였다는 이유로 관계 행정기관으로부터 불이익이나 차별을 받았다는 내용의 진정 등을 제기한 경우에는 그 진정 등을 제기한 자를 대리하여 국민권익위원회에 고충민원을 신청할 수 있다. <신설 2011.7.25>

④ 적극적인 규제개선을 위한 직무집행으로 인하여 발생한 위법행위 등을 이유로 담당공무원 등을 징계하는 경우 중소기업 옴부즈만은 해당 징계권자에게 그 징계의 감경 또는 면제를 건의할 수 있다. <신설 2013.8.6>
