지방세법 시행령 제100조의7(개인지방소득세의 환급 등)

① 법 제103조의15제1항에 따라 소득자에게 환급하는 경우에는 특별징수의무자가 특별징수하여 납부할 지방소득세에서 그 차액을 조정하여 환급한다. 다만, 특별징수의무자가 특별징수하여 납부할 지방소득세가 없을 때에는 행정안전부령으로 정하는 바에 따라 환급한다. <개정 2017.7.26>

② 법 제103조의13에 따라 특별징수의무자가 이미 특별징수하여 납부한 지방소득세에 과오납이 있어 환급하는 경우에도 제1항을 준용한다.

③ 법 제103조의16제1항에 따른 환급신청을 받은 특별징수의무자는 「소득세법 시행령」 제202조의2제1항의 계산식에 따라 계산한 세액의 10분의 1을 환급할 세액으로 하되, 환급할 개인지방소득세가 환급하는 달에 특별징수하여 납부할 개인지방소득세를 초과하는 경우에는 다음 달 이후에 특별징수하여 납부할 개인지방소득세에서 조정하여 환급한다. 다만, 해당 특별징수의무자의 환급신청이 있는 경우에는 특별징수 관할 지방자치단체의 장이 그 초과액을 환급한다. <신설 2020.12.31>
