지방자치법 제199조(설치)

① 2개 이상의 지방자치단체가 공동으로 특정한 목적을 위하여 광역적으로 사무를 처리할 필요가 있을 때에는 특별지방자치단체를 설치할 수 있다. 이 경우 특별지방자치단체를 구성하는 지방자치단체(이하 "구성 지방자치단체"라 한다)는 상호 협의에 따른 규약을 정하여 구성 지방자치단체의 지방의회 의결을 거쳐 행정안전부장관의 승인을 받아야 한다.

② 행정안전부장관은 제1항 후단에 따라 규약에 대하여 승인하는 경우 관계 중앙행정기관의 장 또는 시ㆍ도지사에게 그 사실을 알려야 한다.

③ 특별지방자치단체는 법인으로 한다.

④ 특별지방자치단체를 설치하기 위하여 국가 또는 시ㆍ도 사무의 위임이 필요할 때에는 구성 지방자치단체의 장이 관계 중앙행정기관의 장 또는 시ㆍ도지사에게 그 사무의 위임을 요청할 수 있다.

⑤ 행정안전부장관이 국가 또는 시ㆍ도 사무의 위임이 포함된 규약에 대하여 승인할 때에는 사전에 관계 중앙행정기관의 장 또는 시ㆍ도지사와 협의하여야 한다.

⑥ 구성 지방자치단체의 장이 제1항 후단에 따라 행정안전부장관의 승인을 받았을 때에는 규약의 내용을 지체 없이 고시하여야 한다. 이 경우 구성 지방자치단체의 장이 시장ㆍ군수 및 자치구의 구청장일 때에는 그 승인사항을 시ㆍ도지사에게 알려야 한다.
