지방자치법 제82조(의장이나 의원의 제척)

지방의회의 의장이나 지방의회의원은 본인ㆍ배우자ㆍ직계존비속(直系尊卑屬) 또는 형제자매와 직접 이해관계가 있는 안건에 관하여는 그 의사에 참여할 수 없다. 다만, 의회의 동의가 있으면 의회에 출석하여 발언할 수 있다.
