집회 및 시위에 관한 법률 제6조(옥외집회 및 시위의 신고 등)

①옥외집회나 시위를 주최하려는 자는 그에 관한 다음 각 호의 사항 모두를 적은 신고서를 옥외집회나 시위를 시작하기 720시간 전부터 48시간 전에 관할 경찰서장에게 제출하여야 한다. 다만, 옥외집회 또는 시위 장소가 두 곳 이상의 경찰서의 관할에 속하는 경우에는 관할 시ㆍ도경찰청장에게 제출하여야 하고, 두 곳 이상의 시ㆍ도경찰청 관할에 속하는 경우에는 주최지를 관할하는 시ㆍ도경찰청장에게 제출하여야 한다. <개정 2020.12.22>

②관할 경찰서장 또는 시ㆍ도경찰청장(이하 "관할경찰관서장"이라 한다)은 제1항에 따른 신고서를 접수하면 신고자에게 접수 일시를 적은 접수증을 즉시 내주어야 한다. <개정 2020.12.22>

③ 주최자는 제1항에 따라 신고한 옥외집회 또는 시위를 하지 아니하게 된 경우에는 신고서에 적힌 집회 일시 24시간 전에 그 철회사유 등을 적은 철회신고서를 관할경찰관서장에게 제출하여야 한다. <개정 2016.1.27>

④제3항에 따라 철회신고서를 받은 관할경찰관서장은 제8조제3항에 따라 금지 통고를 한 집회나 시위가 있는 경우에는 그 금지 통고를 받은 주최자에게 제3항에 따른 사실을 즉시 알려야 한다. <개정 2016.1.27>

⑤제4항에 따라 통지를 받은 주최자는 그 금지 통고된 집회 또는 시위를 최초에 신고한 대로 개최할 수 있다. 다만, 금지 통고 등으로 시기를 놓친 경우에는 일시를 새로 정하여 집회 또는 시위를 시작하기 24시간 전에 관할경찰관서장에게 신고서를 제출하고 집회 또는 시위를 개최할 수 있다.
