Enforcement Decree of the Elementary and Secondary Education Act, Article 40-4 (Criteria and Methods for Applying Individual Educational Support for Students)

① 학교의 장과 교원은 법 제20조의4제1항에 따라 학생의 행위가 다음 각 호의 어느 하나에 해당하는 경우로서 다른 학생들의 학습권 보호가 필요하다고 판단하는 경우 해당 학생을 일시적으로 분리하여 개별적으로 교육지원(이하 "개별학생교육지원"이라 한다)을 할 수 있다.

② 학교의 장과 교원은 개별학생교육지원을 다음 각 호의 방법으로 할 수 있다. 이 경우 학교의 장과 교원은 일시적으로 분리된 학생이 수업에 다시 참여할 수 있다고 판단되면 해당 학생을 즉시 수업에 다시 참여시켜야 한다.
