초ㆍ중등교육법 시행령 제41조(교원의 자격)

① 법 제21조에 따른 교원의 자격검정과 교원자격검정위원회의 조직ㆍ권한 및 운영에 필요한 사항은 따로 대통령령으로 정한다.

② 법 별표 2 중 중등학교 정교사(2급) 자격 제9호에 따른 임용권자의 추천 대상자는 법 제31조제1항에 따른 학교운영위원회(이하 "운영위원회"라 한다)의 심의를 거쳐 정하되, 법 제22조에 따른 산학겸임교사 등(명예교사는 제외한다)의 자격을 갖춘 사람 중 임용 예정학교에서 필요로 하는 분야에 특별한 능력을 보유하고 있어 해당 분야의 교육을 담당할 수 있는 사람으로 한다. <개정 2026.4.14>

③ 법 별표 2 중 중등학교 정교사(2급) 자격 제9호에 따른 교육감의 전형은 서류심사와 역량평가 등의 방법으로 실시한다.
