초ㆍ중등교육법 시행령 제42조(산학겸임교사 등)

① 법 제22조에 따른 산학겸임교사 등의 종류는 산학겸임교사, 명예교사, 영어회화 전문강사, 다문화언어 강사, 강사로 하고 그 자격기준은 별표 2와 같다. <개정 2009.8.18, 2013.10.30>

② 제1항에 따른 산학겸임교사 등은 국ㆍ공립학교의 경우에는 학교의 장이, 사립학교의 경우에는 학교법인 또는 사립학교 경영자가 각각 임용한다. 다만, 사립학교의 경우에는 학교법인의 정관 등에서 정하는 바에 따라 그 임용권한을 학교의 장에게 위임할 수 있다. <신설 2009.8.18>

③제2항에 따라 산학겸임교사 등을 임용하고자 하는 때에는 운영위원회의 심의를 거쳐야 한다. 다만, 운영위원회가 구성되지 아니한 학교의 경우에는 그러하지 아니하다. <개정 2009.8.18, 2026.4.14>

④산학겸임교사 등에 대하여는 예산의 범위안에서 수당 등을 지급할 수 있다. <개정 2009.8.18>

⑤ 제1항에 따른 영어회화 전문강사를 기간을 정하여 임용할 때 그 기간은 1년 이내로 하되, 필요한 경우 계속 근무한 기간이 4년을 초과하지 아니하는 범위에서 그 기간을 연장할 수 있다. <신설 2009.8.18>
