초ㆍ중등교육법 시행령 제47조(휴업일 등)

①법 제24조제4항에 따른 학교의 휴업일은 학교의 장이 매 학년도가 시작되기 전에 운영위원회의 심의를 거쳐 정하며, 토요일, 관공서의 공휴일(「관공서의 공휴일에 관한 규정」 제2조에 따른 관공서의 공휴일을 말한다. 이하 같다) 및 여름ㆍ겨울 휴가가 포함되어야 한다. 다만, 임시공휴일이 지정된 것을 반영하여 휴업일을 다시 정하는 경우에는 운영위원회의 심의를 거치지 않을 수 있다. <개정 2001.3.2, 2019.9.24, 2022.3.22, 2026.4.14>

②학교의 장은 비상재해나 그 밖의 급박한 사정이 발생한 때에는 임시휴업을 할 수 있다. <개정 2022.3.22>

③ 학교의 장은 제2항에 따라 임시휴업을 하는 경우에는 지체 없이 관할청에 이를 보고해야 한다. <신설 2022.3.22>

④ 제1항에도 불구하고 학교의 장은 학교의 휴업일에 다음 각 호에 따른 교육활동을 할 수 있다. 이 경우 미리 학생, 학부모 및 교원의 의견을 듣고, 운영위원회의 심의를 거쳐야 한다. <신설 2019.9.24, 2022.3.22, 2026.4.14>

⑤ 학교의 장은 제4항 각 호에 따른 교육활동을 하는 날을 제45조제1항에 따른 수업일수에 포함할 수 있으며, 그 수업일수만큼 제1항에 따른 휴업일을 별도로 정해야 한다. <신설 2019.9.24, 2022.3.22, 2022.8.30, 2026.4.14>
