초ㆍ중등교육법 제11조의2(교육통계조사 등)

① 교육부장관은 초ㆍ중등교육 정책의 효율적인 추진과 초ㆍ중등교육 연구에 필요한 학생ㆍ교원ㆍ직원ㆍ학교ㆍ교육행정기관 등에 대한 기초자료 수집을 위하여 교육통계조사를 매년 실시하고 그 결과를 공개하여야 한다.

② 교육부장관은 초ㆍ중등교육 정책의 효율적인 수립ㆍ시행과 평가를 위하여 제1항에 따른 교육통계조사(이하 이 조에서 "교육통계조사"라 한다)로 수집된 자료와 「통계법」 제3조에 따른 통계 및 행정자료 등을 활용하여 교육 관련 지표 및 학생 수 추계 등 예측통계를 작성하여 공개하여야 한다. <신설 2020.3.24>

③ 교육부장관은 교육통계조사와 제2항에 따른 교육 관련 지표 및 예측통계의 작성을 위하여 중앙행정기관의 장, 지방자치단체의 장, 교육감 및 「공공기관의 운영에 관한 법률」에 따른 공공기관의 장 등 관계 기관의 장에게 자료의 제공을 요청할 수 있다. 이 경우 자료 제공을 요청받은 기관의 장은 특별한 사유가 없으면 이에 따라야 한다. <개정 2020.3.24>

④ 교육감은 제3항에 따른 자료 제출을 위하여 관할 학교 및 교육행정기관의 장 등에게 자료 제출을 요청할 수 있다. 이 경우 자료 제출 요청을 받은 관할 학교 및 교육행정기관의 장 등은 특별한 사유가 없으면 이에 따라야 하며, 교육감은 관할 학교 및 교육행정기관 등의 부담을 최소화하기 위하여 노력하여야 한다. <개정 2020.3.24>

⑤ 교육부장관은 교육통계조사와 교육 관련 지표 및 예측통계 작성의 정확성 제고 및 업무 경감을 위하여 관련 자료를 보유한 중앙행정기관의 장, 지방자치단체의 장, 교육감 및 「공공기관의 운영에 관한 법률」에 따른 공공기관의 장 등 관계 기관의 장에게 자료 간 연계를 요청할 수 있다. 이 경우 자료 간 연계를 요청받은 기관의 장은 특별한 사유가 없으면 이에 따라야 한다. <개정 2020.3.24>

⑥ 교육부장관은 교육통계조사 시 다음 각 호에 해당하는 사람의 주민등록번호가 포함된 개인정보를 수집할 수 있으며, 이를 제5항에 따라 연계를 요청받은 기관에 통계조사 및 분석, 검증 등을 목적으로 제공하거나 제공받을 수 있다. <개정 2020.3.24>

⑦ 교육부장관은 교육통계조사에 의하여 수집된 자료를 이용하고자 하는 자에게 이를 제공할 수 있다. 이 경우 「교육관련기관의 정보공개에 관한 특례법」에 따라 공개되는 항목을 제외하고는 특정의 개인이나 법인 또는 단체를 식별할 수 없는 형태로 자료를 제공한다. <개정 2020.3.24>

⑧ 교육부장관은 교육통계조사 등의 업무를 위하여 대통령령으로 정하는 바에 따라 국가교육통계센터를 지정하여 그 업무를 위탁할 수 있다. 이 경우 교육부장관은 지정이나 업무 위탁에 필요한 경비를 지원할 수 있다.
