특허법 제79조(특허료)

① 제87조제1항에 따른 특허권의 설정등록을 받으려는 자는 설정등록을 받으려는 날(이하 "설정등록일"이라 한다)부터 3년분의 특허료를 내야 하고, 특허권자는 그 다음 해부터의 특허료를 해당 권리의 설정등록일에 해당하는 날을 기준으로 매년 1년분씩 내야 한다.

② 제1항에도 불구하고 특허권자는 그 다음 해부터의 특허료는 그 납부연도 순서에 따라 수년분 또는 모든 연도분을 함께 낼 수 있다.
