Enforcement Decree of the Act on Fair Labeling and Advertising, Article 14 (Cases Where There Are No Sales, etc.)
법 제9조제1항 단서에서 "대통령령으로 정하는 사업자등인 경우"란 사업자등이 다음 각 호의 어느 하나에 해당하는 경우를 말한다. <개정 2024.1.2>
The term "enterprise, etc. prescribed by Presidential Decree" in the proviso of Article 9 (1) of the Act means an enterprise, etc. that falls under any of the following:
1. 영업을 시작하지 아니하거나 영업 중단 등으로 인하여 영업실적이 없는 경우
1. Where there is no business performance because the enterprise, etc. has not commenced business or has suspended business;
2. 재해 등으로 매출액 산정자료가 소멸되거나 훼손되는 등의 사유로 객관적인 매출액의 산정이 곤란한 경우
2. Where it is difficult to objectively calculate sales because the materials for calculating sales have been lost or damaged due to a disaster, etc.;
3. 위반기간 또는 관련 상품등의 범위를 확정할 수 없어 관련매출액의 산정이 곤란한 경우
