표시ㆍ광고의 공정화에 관한 법률 제14조의2(표시ㆍ광고의 자율심의기구등)

① 사업자등의 표시ㆍ광고가 제3조제1항 또는 자율규약에 위반되는지 등을 심의(그 명칭에 관계없이 표시ㆍ광고가 법령 또는 자율규약에 위반되는지를 판단하는 행위를 말한다. 이하 같다)하는 등 부당한 표시ㆍ광고를 방지하기 위한 조직(이하 "자율심의기구등"이라 한다)을 운영하는 자는 대통령령으로 정하는 바에 따라 공정거래위원회에 신고할 수 있다.

② 자율심의기구등은 표시ㆍ광고를 심의할 때에 제3조제1항이나 자율규약에 따라 판단하여야 하며, 정당한 사유 없이 사업자등의 표시ㆍ광고 또는 소비자에 대한 정보 제공을 제한하여서는 아니 된다.

③ 공정거래위원회는 자율심의기구등에 심의 내용이나 처리 결과 등에 관한 자료를 요청할 수 있다.

④ 공정거래위원회는 자율심의기구등의 심의 내용이나 처리 결과 등이 제2항을 위반한 경우에는 그 시정을 요구할 수 있으며, 자율심의기구등은 특별한 사유가 없으면 시정 요구에 따라야 한다.

⑤ 공정거래위원회는 표시ㆍ광고가 자율심의기구등의 심의 대상에 해당되는 것으로 판단하는 경우에는 자율심의기구등에 그 표시ㆍ광고의 심의를 요청할 수 있다.

⑥ 공정거래위원회는 자율심의기구등이 제5항에 따라 공정거래위원회가 요청한 심의 대상 표시ㆍ광고를 심의하여 처리한 결과에 따라 사업자등이 부당한 표시ㆍ광고 행위를 시정한 경우에는 제7조에 따른 시정조치명령을 하지 아니한다. 다만, 사업자등이 자율심의기구등이 심의하여 처리한 결과에 따라 시정한 경우라도 이 법을 위반하는 행위를 반복하는 등 자율심의기구등의 시정만으로는 소비자나 경쟁사업자의 피해를 방지하기 곤란하다고 판단하는 경우에는 그러하지 아니하다.

⑦ 공정거래위원회는 제1항에 따라 신고한 자율심의기구등(제6조제1항 단서에 따라 공정거래위원회가 인정하는 사업자단체의 자율심의기구 및 다른 법령에 따라 심의를 위임받은 심의기구를 포함한다)이 제5항에 따라 공정거래위원회가 요청한 심의를 한 경우에는 예산의 범위에서 그 경비를 보조할 수 있다.
