하도급거래 공정화에 관한 법률 시행령 제10조의2(포상금의 지급)

① 법 제22조제5항에 따른 포상금 지급대상자는 같은 항에서 규정한 법 위반행위(이하 이 조에서 "법 위반행위"라 한다)를 신고하거나 제보하고 법 위반행위를 입증할 수 있는 증거자료를 최초로 제출한 자로 한다.

② 제1항에도 불구하고 다음 각 호의 어느 하나에 해당하는 자는 포상금 지급대상자에서 제외한다. 다만, 제3호에 해당하는 자 중 다른 수급사업자와 관련된 법 위반행위를 입증할 수 있는 증거자료를 최초로 제출한 수급사업자는 포상금 지급대상자에 포함한다. <개정 2026.8.4>

③ 공정거래위원회는 특별한 사정이 있는 경우를 제외하고 신고 또는 제보된 행위가 법 위반행위에 해당한다고 인정하여 해당 행위를 한 원사업자에게 시정조치 등의 처분을 하기로 의결한 날(처분에 대한 이의신청이 있는 경우에는 이의신청에 대한 재결이 있은 날을 말한다)부터 3개월 이내에 포상금을 지급한다.

④ 제3항에 따라 지급되는 포상금에 관하여 법 위반행위의 유형별 구체적인 지급기준은 법 위반행위의 중대성 및 증거의 수준 등을 고려하여 공정거래위원회가 정하여 고시한다.

⑤ 제3항에 따른 포상금의 지급에 관한 사항을 심의하기 위하여 공정거래위원회에 신고포상금심의위원회를 둘 수 있다.

⑥ 제5항에 따른 신고포상금심의위원회의 설치ㆍ운영에 관한 사항, 그 밖에 포상금 지급의 기준ㆍ절차 등에 관한 세부사항은 공정거래위원회가 정하여 고시한다.
