행정기본법 시행령 제13조(처분의 재심사 신청 방법 등)

① 법 제37조제1항에 따라 처분의 재심사를 신청하려는 자는 다음 각 호의 사항을 적은 문서에 처분의 재심사 신청 사유를 증명하는 서류를 첨부하여 해당 처분을 한 행정청에 제출해야 한다.

② 제1항에 따른 신청을 받은 행정청은 그 신청 내용에 보완이 필요하면 보완해야 할 내용을 명시하고 20일 이내에서 적절한 기간을 정하여 보완을 요청할 수 있다.

③ 제2항에 따른 보완 기간은 법 제37조제4항에 따른 재심사 결과 통지 기간에 포함하지 않는다.

④ 행정청은 법 제37조제4항 단서에 따라 처분의 재심사 결과의 통지 기간을 연장하려는 경우에는 연장 통지서에 연장 사유와 연장 기간 등을 구체적으로 적어야 한다.
