형법 제365조(친족 사이의 범행)

① 제362조부터 제364조까지의 죄를 지은 사람이 피해자의 친족인 경우에는 제328조를 준용한다.

② 제362조부터 제364조까지의 죄를 지은 사람이 본범과 배우자, 직계혈족ㆍ동거친족 또는 그 배우자의 관계인 경우에는 그 형을 감경하거나 면제할 수 있다. 다만, 신분관계가 없는 공범에 대해서는 예외로 한다.
