형사보상 및 명예회복에 관한 법률 제5조(보상의 내용)

① 구금에 대한 보상을 할 때에는 그 구금일수(拘禁日數)에 따라 1일당 보상청구의 원인이 발생한 연도의 「최저임금법」에 따른 일급(日給) 최저임금액 이상 대통령령으로 정하는 금액 이하의 비율에 의한 보상금을 지급한다.

② 법원은 제1항의 보상금액을 산정할 때 다음 각 호의 사항을 고려하여야 한다. <개정 2018.3.20, 2026.3.24>

③ 사형 집행에 대한 보상을 할 때에는 집행 전 구금에 대한 보상금 외에 3천만원 이내에서 모든 사정을 고려하여 법원이 타당하다고 인정하는 금액을 더하여 보상한다. 이 경우 본인의 사망으로 인하여 발생한 재산상의 손실액이 증명되었을 때에는 그 손실액도 보상한다.

④ 벌금 또는 과료(科料)의 집행에 대한 보상을 할 때에는 이미 징수한 벌금 또는 과료의 금액에 징수일의 다음 날부터 보상 결정일까지의 일수에 대하여 「민법」 제379조의 법정이율을 적용하여 계산한 금액을 더한 금액을 보상한다.

⑤ 노역장유치(勞役場留置)의 집행을 한 경우 그에 대한 보상에 관하여는 제1항을 준용한다.

⑥ 몰수(沒收) 집행에 대한 보상을 할 때에는 그 몰수물을 반환하고, 그것이 이미 처분되었을 때에는 보상결정 시의 시가(時價)를 보상한다.

⑦ 추징금(追徵金)에 대한 보상을 할 때에는 그 액수에 징수일의 다음 날부터 보상 결정일까지의 일수에 대하여 「민법」 제379조의 법정이율을 적용하여 계산한 금액을 더한 금액을 보상한다.
