형사소송법 제190조(제삼자의 소송비용부담)

①검사 아닌 자가 상소 또는 재심청구를 한 경우에 상소 또는 재심의 청구가 기각되거나 취하된 때에는 그 자에게 그 소송비용을 부담하게 할 수 있다.

②피고인 아닌 자가 피고인이 제기한 상소 또는 재심의 청구를 취하한 경우에도 전항과 같다.
