형사소송법 제346조(상소권회복 청구의 방식)

① 상소권회복을 청구할 때에는 제345조의 사유가 해소된 날부터 상소 제기기간에 해당하는 기간 내에 서면으로 원심법원에 제출하여야 한다.

② 상소권회복을 청구할 때에는 제345조의 책임질 수 없는 사유를 소명하여야 한다.
