화물자동차 운수사업법 제40조의4(위ㆍ수탁계약의 양도ㆍ양수)

① 위ㆍ수탁차주는 운송사업자의 동의를 받아 제40조제3항에 따른 위ㆍ수탁계약상의 지위를 타인에게 양도할 수 있다. 다만, 다음 각 호의 어느 하나의 해당하는 사유가 발생하는 경우에는 운송사업자는 양수인이 제8조에 따른 화물운송 종사자격을 갖추지 못한 경우 등 대통령령으로 정하는 경우를 제외하고는 위ㆍ수탁계약의 양도에 대한 동의를 거절할 수 없다.

② 제1항에 따라 위ㆍ수탁계약상의 지위를 양수한 자는 양도인의 위ㆍ수탁계약상 권리와 의무를 승계한다.

③ 제1항 단서에 따라 위ㆍ수탁계약상의 지위를 양도하는 경우 위ㆍ수탁차주는 운송사업자에게 양도 사실을 서면으로 통지하여야 한다.

④ 제3항의 통지가 있은 날부터 1개월 이내에 운송사업자가 양도에 대한 동의를 거절하지 아니하는 경우에는 운송사업자가 양도에 동의한 것으로 본다.
