화물자동차 운수사업법 제6조(운송약관)

① 운송사업자는 운송약관을 정하여 국토교통부장관에게 신고하여야 한다. 이를 변경하려는 때에도 또한 같다. <개정 2013.3.23>

② 국토교통부장관은 제1항에 따른 신고 또는 변경신고를 받은 날부터 3일 이내에 신고수리 여부를 신고인에게 통지하여야 한다. <신설 2017.3.21>

(2) The^ð더 Minister미너스터 of어^v브 Land,랜드 Infrastructure인^f프^r러스트^r럭처 and앤드 Transport트^r랜스포트 shall섈 notify노우터^f파이 the^ð더 person퍼슨 filing^f파일링 a어 report^r리포트 of어^v브 whether웨^ð더 the^ð더 report^r리포트 is이즈 accepted액셉티드 within위^ð딘 three^θ쓰^r리 days데이즈 from^f프^r럼 the^ð더 date데잇 of어^v브 receiving^r러시^v빙 a어 report^r리포트 or오 report^r리포트 of어^v브 change체인지 under언더 paragraph패^r러그^r래^f프 (1).

③ 국토교통부장관이 제2항에서 정한 기간 내에 신고수리 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장 여부를 신고인에게 통지하지 아니하면 그 기간이 끝난 날의 다음 날에 신고를 수리한 것으로 본다. <신설 2017.3.21>

(3) If이^f프 the^ð더 Minister미너스터 of어^v브 Land,랜드 Infrastructure인^f프^r러스트^r럭처 and앤드 Transport트^r랜스포트 fails^f페일즈 to투 notify노우터^f파이 the^ð더 person퍼슨 filing^f파일링 a어 report,^r리포트 within위^ð딘 the^ð더 period피^r리어드 set셋 in인 paragraph패^r러그^r래^f프 (2), of어^v브 whether웨^ð더 the^ð더 report^r리포트 is이즈 accepted액셉티드 or오 of어^v브 an앤 extension익스텐션 of어^v브 the^ð더 processing프^r라세싱 period피^r리어드 under언더 the^ð더 laws로즈 and앤드 regulations^r레귤레이션즈 on안 handling핸들링 civil시^v블 petitions,퍼티션즈 the^ð더 report^r리포트 shall섈 be비 deemed딤드 accepted액셉티드 on안 the^ð더 day데이 after애^f프터 that^ð댓 period피^r리어드 ends.엔즈

④ 국토교통부장관은 제48조 또는 제50조에 따라 설립된 협회 또는 연합회가 작성한 것으로서 「약관의 규제에 관한 법률」 제19조의2에 따라 공정거래위원회의 심사를 거친 화물운송에 관한 표준이 되는 약관(이하 "표준약관"이라 한다)이 있으면 운송사업자에게 그 사용을 권장할 수 있다. <개정 2013.3.23, 2017.3.21>

(4) Where웨어 there^ð데어 are아 terms텀즈 and앤드 conditions컨디션즈 that^ð댓 serve서^v브 as애즈 a어 standard스탠더드 for^f포 freight^f프^r레잇 transport트^r랜스포트 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 "standard스탠더드 terms텀즈 and앤드 conditions"),컨디션즈 prepared프^r리페어드 by바이 an앤 association어소우시에이션 or오 federation^f페더^r레이션 established이스태블리시트 under언더 Article아터클 48 or오 50 and앤드 reviewed^r리^v뷰드 by바이 the^ð더 Fair^f페어 Trade트^r레이드 Commission커미션 under언더 Article아터클 19-2 of어^v브 the^ð디 Act액트 on안 the^ð더 Regulation^r레귤레이션 of어^v브 Terms텀즈 and앤드 Conditions,컨디션즈 the^ð더 Minister미너스터 of어^v브 Land,랜드 Infrastructure인^f프^r러스트^r럭처 and앤드 Transport트^r랜스포트 may메이 recommend^r레커멘드 that^ð댓 freight^f프^r레잇 transport트^r랜스포트 operators아퍼^r레이터즈 use유스 them.^ð뎀

⑤ 운송사업자가 제3조에 따른 화물자동차 운송사업의 허가(변경허가를 포함한다)를 받는 때에 표준약관의 사용에 동의하면 제1항에 따라 신고한 것으로 본다. <개정 2017.3.21>

(5) If이^f프 a어 freight^f프^r레잇 transport트^r랜스포트 operator아퍼^r레이터 agrees어그^r리즈 to투 use유스 the^ð더 standard스탠더드 terms텀즈 and앤드 conditions컨디션즈 when웬 obtaining어브테이닝 a어 permit퍼밋 for^f포 the^ð더 truck트^r럭 freight^f프^r레잇 transport트^r랜스포트 business비즈니스 under언더 Article아터클 3 (including인클루딩 a어 permit퍼밋 for^f포 a어 change),체인지 it잇 shall섈 be비 deemed딤드 to투 have해^v브 filed^f파일드 a어 report^r리포트 under언더 paragraph패^r러그^r래^f프 (1).
