가정폭력범죄의 처벌 등에 관한 특례법 제18조(비밀엄수 등의 의무)

① 가정폭력범죄의 수사 또는 가정보호사건의 조사ㆍ심리 및 그 집행을 담당하거나 이에 관여하는 공무원, 보조인, 상담소등에 근무하는 상담원과 그 기관장 및 제4조제2항제1호에 규정된 사람(그 직에 있었던 사람을 포함한다)은 그 직무상 알게 된 비밀을 누설하여서는 아니 된다.

② 이 법에 따른 가정보호사건에 대하여는 가정폭력행위자, 피해자, 고소인, 고발인 또는 신고인의 주소, 성명, 나이, 직업, 용모, 그 밖에 이들을 특정하여 파악할 수 있는 인적 사항이나 사진 등을 신문 등 출판물에 싣거나 방송매체를 통하여 방송할 수 없다.

③ 피해자가 보호하고 있는 아동이나 피해자인 아동의 교육 또는 보육을 담당하는 학교의 교직원 또는 보육교직원은 정당한 사유가 없으면 해당 아동의 취학, 진학, 전학 또는 입소(그 변경을 포함한다)의 사실을 가정폭력행위자인 친권자를 포함하여 누구에게든지 누설하여서는 아니 된다. <개정 2011.6.7>
