고용정책 기본법 제38조(보고 및 검사)

① 고용노동부장관은 고용정보의 수집ㆍ제공, 고용관리 및 고용조정의 지원 등과 관련하여 필요하다고 인정하면 대통령령으로 정하는 바에 따라 사업주와 이 법에 따른 지원을 받았거나 받으려는 자에게 고용관리의 현황, 지원금의 사용 명세, 지원의 적합 여부 등 필요한 사항을 보고하게 할 수 있다. <개정 2010.6.4>

② 고용노동부장관은 고용관리 및 고용조정의 지원과 관련하여 법 위반 사실의 확인 등이 필요하다고 인정하면 관계 공무원에게 사업주의 사무소 또는 사업장에 출입하여 관계자에게 질문하게 하거나 서류를 검사하게 할 수 있다. <개정 2010.6.4>

③ 고용노동부장관은 제2항에 따라 검사하려면 해당 사업주에게 검사일시와 검사내용 등 검사에 필요한 사항을 미리 알려야 한다. 다만, 긴급히 처리할 필요가 있거나 미리 알릴 경우 그 목적을 달성할 수 없다고 인정하는 경우에는 그러하지 아니하다. <개정 2010.6.4>

④ 제2항에 따라 검사를 하는 관계 공무원은 그 신분을 표시하는 증명서를 지니고 이를 관계자에게 보여주어야 한다.

⑤ 고용노동부장관은 제2항부터 제4항까지의 규정에 따라 검사를 한 경우에는 해당 사업주에게 그 결과를 서면으로 알려야 한다. <개정 2010.6.4>
