공공주택 특별법 제49조의6(공공분양주택의 예외적 전매 허용 시 주택의 매입 등)

① 공공분양주택을 공급받은 자가 제49조의5제1항 또는 「주택법」 제64조제1항에 따른 전매제한기간에 같은 조 제2항 본문의 사유에 해당되어 해당 입주자로 선정된 지위 또는 주택(지분적립형 분양주택의 경우 주택의 소유 지분을 말한다. 이하 이 조에서 같다)을 전매(입주자로 선정된 지위 또는 주택의 일부를 배우자에게 증여하는 경우는 제외한다)할 수 있다고 인정되는 경우 공공분양주택을 공급받은 자는 공공주택사업자에게 입주자로 선정된 지위 또는 주택의 매입을 신청하여야 한다. <개정 2021.5.18>

② 제1항에 따라 매입신청을 받은 공공주택사업자는 대통령령으로 정하는 특별한 사유가 없으면 해당 입주자로 선정된 지위 또는 주택을 매입하여야 한다.

③ 공공주택사업자가 제2항에 따라 입주자로 선정된 지위 또는 주택을 매입하는 경우 매입비용과 입주자로 선정된 지위 또는 주택의 취득에 관하여는 「주택법」 제57조의2제4항을 준용한다. <개정 2020.8.18>

④ 공공주택사업자는 제2항 및 제3항에 따라 취득한 입주자로 선정된 지위 또는 주택을 국토교통부령으로 정하는 바에 따라 공급하여야 한다.
