공직선거법 제140조(창당대회 등의 개최와 고지의 제한)

①정당이 선거일전 120일(선거일전 120일후에 실시사유가 확정된 보궐선거 등에 있어서는 그 선거의 실시사유가 확정된 때)부터 선거일까지 창당대회ㆍ합당대회ㆍ개편대회 및 후보자선출대회( 이하 이 조에서 "창당대회 등"이라 한다)를 개최하는 때에는 다수인이 왕래하는 공개된 장소가 아닌 장소에서 소속당원(후보자선출대회의 경우에는 당해 정당의 공직선거후보자를 선출하기 위한 투표권이 있는 당원이 아닌 자를 포함한다)만을 대상으로 개최하여야 하되, 사회통념상 인정되는 범위안에서 당원이 아닌 자를 초청할 수 있다. <개정 2004.3.12, 2005.8.4>

②제1항의 창당대회등을 주관하는 정당은 「정당법」 제10조(창당집회의공개)제2항의 신문공고를 하는 외에 창당대회등의 장소에 5매이내의 표지를 게시할 수 있다. 이 경우 신문공고ㆍ표지에는 후보자(후보자가 되고자 하는 자를 포함한다. 이하 이 항에서 같다)의 사진ㆍ성명(성명을 유추할 수 있는 내용을 포함한다) 또는 선전구호등 후보자를 선전하는 내용을 게재할 수 없다. <개정 2004.3.12, 2005.8.4>

③제1항에서 "개편대회"라 함은 정당의 대표자의 변경 등 당헌ㆍ당규상의 조직개편에 관한 안건을 처리하기 위하여 개최하는 당원총회 또는 그 대의기관의 회의 등 집회를 말하고, "후보자선출대회"라 함은 정당의 각급 당부가 이 법에 의한 선거의 당해 정당추천후보자를 선출하기 위하여 제57조의2(당내경선의 실시)의 규정에 의하여 개최하는 집회를 말한다. <신설 2000.2.16, 2005.8.4>
