공직선거법 제239조(직권남용에 의한 선거의 자유방해죄)
Public Official Election Act, Article 239 (Crime of Obstructing the Freedom of Elections by Abuse of Authority)
선거에 관하여 선거관리위원회의 위원ㆍ직원, 선거사무에 종사하는 공무원 또는 선거인명부(재외선거인명부등을 포함한다. 이하 이 장에서 같다)작성에 관계있는 자나 경찰공무원(사법경찰관리 및 군사법경찰관리를 포함한다)이 직권을 남용하여 다음 각 호의 어느 하나에 해당하는 행위를 하거나 하게 한 때에는 7년 이하의 징역에 처한다. <개정 2005.8.4, 2009.2.12>
If, in connection with an election, a commissioner or employee of an election commission, a public official engaged in election affairs, a person involved in preparing the electoral register (including the overseas electoral register, etc.; the same applies hereinafter in this Chapter), or a police officer (including judicial police officers and military judicial police officers) abuses his or her authority to commit, or have someone commit, any of the following acts, he or she shall be punished by imprisonment with labor for not more than seven years:
1. 선거인명부의 열람을 방해하거나 그 열람에 관한 직무를 유기한 때
1. Obstructing inspection of the electoral register or abandoning duties relating to its inspection;
2. 정당한 사유없이 후보자를 미행하거나 그 주택ㆍ선거사무소 또는 선거연락소에 승낙없이 들어가거나 퇴거요구에 불응한 때
2. Following a candidate without a justifiable reason, entering the candidate's house, election campaign office, or election liaison office without consent, or refusing to leave when asked to.
