공직선거법 제257조(기부행위의 금지제한 등 위반죄)

①다음 각호의 1에 해당하는 자는 5년 이하의 징역 또는 1천만원 이하의 벌금에 처한다. <개정 1996.2.6, 1997.1.13, 1997.11.14, 2000.2.16, 2004.3.12>

②제81조제6항ㆍ제82조제4항ㆍ제113조ㆍ제114조제1항 또는 제115조에서 규정하고 있는 정당(창당준비위원회를 포함한다)ㆍ정당의 대표자ㆍ정당선거사무소의 소장, 국회의원ㆍ지방의회의원ㆍ지방자치단체의 장, 후보자(후보자가 되고자 하는 자를 포함한다. 이하 이 조에서 같다), 후보자의 배우자, 후보자나 그 배우자의 직계존비속과 형제자매, 후보자의 직계비속 및 형제자매의 배우자, 선거사무장, 선거연락소장, 선거사무원, 회계책임자, 연설원,대담ㆍ토론자, 후보자 또는 그 가족과 관계있는 회사 등이나 그 임ㆍ직원과 제삼자[제116조(寄附의 勸誘ㆍ요구 등의 금지)에 규정된 행위의 상대방을 말한다]에게 기부를 지시ㆍ권유ㆍ알선ㆍ요구하거나 그로부터 기부를 받은 자(제261조제9항제1호ㆍ제6호에 해당하는 사람은 제외한다)는 3년 이하의 징역 또는 500만원 이하의 벌금에 처한다. <개정 1997.1.13, 2000.2.16, 2004.3.12, 2008.2.29, 2010.1.25, 2012.2.29, 2014.2.13>
