공직선거법 제271조(불법시설물 등에 대한 조치 및 대집행)

①각급선거관리위원회는 이 법의 규정에 위반되는 선거에 관한 벽보ㆍ인쇄물ㆍ현수막 기타 선전물(정당의 당사게시선전물을 포함한다)이나 유사기관ㆍ사조직 또는 시설 등을 발견한 때에는 지체없이 그 첩부 등의 중지 또는 철거ㆍ수거 ㆍ폐쇄 등을 명하고, 이에 불응하는 때에는 대집행을 할 수 있다. 이 경우 대집행은 「행정대집행법」에 의하되, 그 절차는 「행정대집행법」 제3조(代執行의 節次)의 규정에 불구하고 중앙선거관리위원회규칙이 정하는 바에 의할 수 있다. <개정 1997.11.14, 2005.8.4>

②각급선거관리위원회는 제1항의 불법시설물 등에 중앙선거관리위원회규칙이 정하는 바에 따라 불법시설물임을 표시하는 표지를 하거나 공고할 수 있다.
