공직선거법 제56조(기탁금)

① 후보자등록을 신청하는 자는 등록신청 시에 후보자 1명마다 다음 각 호의 기탁금(후보자등록을 신청하는 사람이 「장애인복지법」 제32조에 따라 등록한 장애인이거나 선거일 현재 29세 이하인 경우에는 다음 각 호에 따른 기탁금의 100분의 50에 해당하는 금액을 말하고, 30세 이상 39세 이하인 경우에는 다음 각 호에 따른 기탁금의 100분의 70에 해당하는 금액을 말한다)을 중앙선거관리위원회규칙으로 정하는 바에 따라 관할선거구선거관리위원회에 납부하여야 한다. 이 경우 예비후보자가 해당 선거의 같은 선거구에 후보자등록을 신청하는 때에는 제60조의2제2항에 따라 납부한 기탁금을 제외한 나머지 금액을 납부하여야 한다. <개정 1997.11.14, 2000.2.16, 2001.10.8, 2002.3.7, 2010.1.25, 2012.1.17, 2020.3.25, 2022.4.20>

②제1항의 기탁금은 체납처분이나 강제집행의 대상이 되지 아니한다.

③ 제261조에 따른 과태료 및 제271조에 따른 불법시설물 등에 대한 대집행비용은 제1항의 기탁금(제60조의2제2항의 기탁금을 포함한다)에서 부담한다. <개정 2010.1.25>

④ 제1항에 따라 장애인 또는 39세 이하의 사람이 납부하는 기탁금의 감액비율은 중복하여 적용하지 아니한다. <신설 2022.4.20>
