국가공무원법 제74조의3(별정직공무원의 자진퇴직에 따른 수당)

① 다른 법률에 특별한 규정이 있는 경우 외에는 별정직공무원(비서관ㆍ비서는 제외한다)이 직제와 정원의 개폐 또는 예산의 감소 등으로 폐직 또는 과원이 되었을 때에 스스로 퇴직하면 예산의 범위에서 수당을 지급할 수 있다. <개정 2011.5.23>

② 제1항에 따른 수당의 지급대상범위ㆍ지급액ㆍ지급절차 등에 필요한 사항은 대통령령등으로 정한다. <개정 2015.5.18>
